LOCATION OF PROPERTY:  The property is located at 93-8318 Lauhala Street, Ocean View, Hawaii, 96737 within the Hawaiian Ocean View Ranchos subdivision.  The property is 3.315 acres, more or less, with one blue two-story house.

STRUCTURES:  There is one two-story house.  The interior is unfinished.  There are no appliances.  House is on catchment system.  No representations are made concerning the condition of the premises.  Interested parties are encourage to attend open houses to do their own inspection.

AUCTION DATE:  POSTPONED UNTIL FURTHER NOTICE  Public auction of the property will be had on Tuesday, February 21, 2012 at Noon at the front entrance of Hale Kaulike (aka the "Hilo Courthouse)(pictured to the right), 777 Kilauea Avenue, Hilo, Hawaii, 96720.  


OPEN HOUSES:  The property was open for inspection from 11:00 a.m. to 2:00 p.m. on Saturday, January 28, 2012.  The open house previous scheduled for Sunday, February 5, 2012 is CANCELLED due to the postponement of the sale..

PRIVATE SHOWINGS:  None.  Interested persons are strongly encouraged to attend the open houses to inspect the premises.  Under ideal circumstances, requests for private showings can only rarely be accommodated because they increase the cost of the foreclosure to the parties.  Commissioners are paid on an hourly fee basis from the proceeds of the auction.  The Commissioner will NOT be able to accommodate requests for privates showing of this property due to its distance from Hilo.

TERMS OF SALE:  The property is sold "AS IS" to the highest bidder at public auction with no upset price.  THE SALE IS NOT FINAL UNTIL APPROVED AN CONFIRMED BY THE COURT.  The highest bidder for the property is request to make a down payment in case, certified check, or cashier's check at the time of the bid in an amount equal to ten percent (10%) of the bid price.  The balance of the bi must be paid to the Commissioner upon approval and confirmation of the sale by the Court.  The purchaser is responsible for paying the cost of conveyancing, including document preparation, recordation, conveyance tax, and securing possession of the property.

PREQUALIFICATION OF BIDDERS:  All bidders at the public auction MUST prequalify before bidding begins.  Immediately prior to the auction, the Commissioner will require all interested persons to show they are ready and able to make the 10% down payment at the conclusion of bidding.  This information is not shared with other bidders.  During the auction, a bidder may not exceed the amount established as his or her maximum bid.  For example, if you come to the auction with $50,000.00, your maximum bid is $500,000.00.  You do not have to bid that amount, but you cannot go over that amount.  If you have questions about this requirement, please contact the Commissioner in advance of the auction date.

WHEN:  NOT YET SET.  The confirmation is set after the auction. Please check back.

WHERE:  The confirmation hearing will be held before the Hon. Gregg K. Nakamura, Judge of the Third Circuit Court, in his courtroom at Hale Kaulike (the "Hilo Courthouse"), 777 Kilaue Avenue, 3rd Floor, Hilo, Hawaii.  

WHAT HAPPENS: 
At the hearing, Judge Nakamura will decide whether or not to allow the property to be sold for the high bid at the auction. Bidding can also be re-opened at the hearing.  Judges usually require an opening bid of 5% more than the bid received at the public auction.
